FCC issues $11,000 fine for non-compliance

The FCC has fined a company $11,000 for placing a non compliant Wireless Access Point on the market.

The Wireless Access Point was operating in the 5.250 -5.350GHz frequency band which did not comply with FCC rule Part 15.407(h)(2) Dynamic Frequency Selection (DFS), in addition the product failed to fulfil labelling requirements of 2.925(a)(1).

The FCC rules highlighted that the unit failed to comply with state:

Radar Detection Function of Dynamic Frequency Selection. U-NII devices operating in the 5.25-5.35 GHz and 5.47-5.725 GHz bands shall employ a DFS radar detection mechanism to detect the presence of radar systems and to avoid co-channel operation with radar systems.

2.925(a)(1)

Each equipment covered in an application for equipment authorization shall bear a nameplate or label listing the following: (1) FCC Identifier consisting of the two elements in the exact order specified in §2.926. The FCC Identifier shall be preceded by the term FCC ID in capital letters on a single line, and shall be of a type size large enough to be legible without the aid of magnification.
